Can anyone tell me with this brief background should I divorce my husband of only 5 months?

My husband got angry and jumped on me restraining me and yelling in my face. He finally got off and I went to call his mom. In return, he called the police and falsely reported to the police that I chased him around our home with a knife; he ven went so far as to plant a knife outside our house. I was arrested. He later said he did this to cover his own butt. Since then, he has called the poilce AGAIN with no JUST CAUSE. He then serves me with divorce papers but he never filed them...he through them in my face saying "you've been served" Come to find out...although the papers hada Marshall's signature...HE NEVER FILED THEM!!!
