Should we put parental controls on a 17 yo daughters phone ? ie: , 8 am to 3 pm (school) and 11pm to 7 am.?

Several times when we have checkd our bill , we find our daughter has been texting during school hrs and sometimes late at night . (after midnight) Parental controls are avaible , but mom says no and I say yes ? help please.
