Should I take them to small claims court, or just call their attorney AGAIN?!

i have a settlement that is to be paid by my ex employeer. i am to be paid every 30 days, but every month i have to call their attorney to tell him i have not received my payment yet. They average 15 to 20 days late each month. I dont think it is my responsibility to call and "remind" them to pay me...i am thinking about just filing a small claim against them
